These Terms of Use ("Terms") govern your use of the Farma360 mobile application ("Application")
and related services ("Services") provided by FARMA360 TARIM VE HAYVANCILIK TEKNOLOJİ
ANONİM ŞİRKETİ ("Farma360", "Company", "we", "us").
By downloading, installing, logging into your account, or otherwise using the Application,
you acknowledge that you have read, understood, and agree to be bound by these Terms. If you
do not accept these Terms, do not use the Application.
2. Definitions
"Application": The Farma360 mobile application (iOS and Android).
"Services": All digital services provided through the Application, including farm management, animal tracking, qurban sales management, customer tracking, and related services.
"User" / "You": The natural person using the Application (farm owner, business operator, or shareholder accessing via tracking code).
"Content": All text, photographs, videos, and other materials uploaded, shared, or created through the Application.
"Account": The user account created on your behalf by the Farma360 team to provide access to the Services.
3. Eligibility
To use the Application, you must:
Be at least 18 years of age.
Have the legal capacity to enter into binding agreements in your jurisdiction.
Not have had your account previously suspended or terminated by Farma360.
By using the Application, you represent and warrant that you meet the above eligibility
requirements.
4. Account Registration and Security
4.1 Account Creation
Farma360 accounts are created by the Farma360 team following business verification. To request
an account, you must contact us directly. You are responsible for ensuring that the information
you provide during account creation is accurate, complete, and up to date.
4.2 Account Security
You are responsible for keeping your password confidential and not sharing it with third parties.
You are responsible for all activities that occur under your account.
If you become aware of unauthorized access to your account, you must immediately notify us at info@farma360tech.com.
Farma360 is not liable for any damages resulting from a breach of your account security.
4.3 Password Reset
If you forget your password, you can reset it using an SMS verification code (OTP) sent to
your registered phone number. You are responsible for keeping your phone number up to date.
5. Scope of Services
Farma360 provides the following digital services for the agriculture and livestock industry:
5.1 Farm Management
Recording and editing business information, displaying farm locations on the map, and
tracking business capacity.
5.2 Animal Tracking
Creating animal records (ear tag number, breed, gender, weight, etc.), tracking weight
history, adding photos and videos, and managing purchase/sale information.
5.3 Qurban Sales Management
Recording qurban sales, managing shares, tracking buyer information, generating tracking
codes, managing slaughter and delivery plans, and notifying buyers via WhatsApp.
5.4 Customer Tracking
Enabling shareholders who access via tracking code to follow the sales process, view animal
and slaughter information, communicate with other shareholders, and submit satisfaction
reviews.
Shareholder Information Sharing: When you use the customer tracking feature,
you can access the names and phone numbers of other shareholders of the same animal; other
shareholders can also access your information. By using this feature, you consent to this
sharing arrangement.
5.5 Dashboard
Viewing herd summaries, animal counts, weather information, and business statistics.
6. Usage Rules
6.1 Permitted Use
You may use the Application only for the following purposes:
Managing your own agriculture and livestock business.
Managing qurban sales and tracking processes within your legitimate commercial activities.
Viewing your share information using a tracking code.
6.2 Prohibited Uses
The following uses are strictly prohibited:
Using the Application for any unlawful purpose.
Creating accounts or entering information with false, misleading, or fraudulent information.
Attempting to gain unauthorized access to other users' accounts.
Attempting to circumvent, disrupt, or test the Application's security mechanisms.
Subjecting the Application to reverse engineering, source code extraction, or decompilation.
Using automated tools (bots, scrapers, etc.) to access or collect data.
Collecting, storing, or sharing other users' personal data without permission.
Using the Application for spam, fraud, or distribution of malicious software.
Engaging in activities contrary to animal welfare, public health, or food safety.
Violating applicable laws, these Terms, or third-party rights.
7. User Content
7.1 Content Responsibility
You are responsible for all content (photos, videos, text, animal information, etc.) that
you upload, share, or create through the Application. You represent and warrant that your
content:
Is accurate and up to date,
Does not infringe third-party rights (copyright, trademark, privacy, etc.),
Complies with applicable laws.
7.2 Content License
You retain ownership of content you upload to the Application. However, by uploading content,
you grant Farma360 a limited, non-exclusive, royalty-free, sublicensable license to use such
content as necessary for the provision of the Services. This license is valid solely for the
purpose of providing the Services and terminates upon deletion of your account.
7.3 Content Removal
Farma360 reserves the right to remove any content that violates these Terms or applicable
laws without prior notice.
8. Intellectual Property
All intellectual property rights in the Application and Services (including design, software,
graphics, logos, icons, text, and all other elements) belong to Farma360 or its licensors.
The "Farma360" name, logo, and related marks are registered trademarks.
Copying, distributing, modifying, or creating derivative works of the Application is prohibited.
Under these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Application for personal and commercial purposes (for your own business).
9. Third-Party Services
The Application uses third-party services for certain features. These services have their
own terms of use and privacy policies:
Apple App Store / Google Play: Application distribution platforms.
Farma360 does not guarantee the uninterrupted or error-free operation of third-party services
and is not liable for damages arising from the use of such services.
10. Service Level and Interruptions
Farma360 provides the Services on an "as is" basis.
Temporary service interruptions may occur due to scheduled maintenance, updates, or technical reasons.
Scheduled maintenance will be communicated in advance whenever possible.
Farma360 shall not be held liable for interruptions caused by force majeure events (natural disasters, war, cyberattacks, changes in legislation, etc.).
Farma360 reserves the right to modify, update, or remove the features, content, or functionality of the Application at any time.
11. Limitation of Liability
11.1 Disclaimer of Warranties
The Application and Services are provided "as is" and "as available." Farma360 makes no
express or implied warranties; in particular, no warranty is made regarding:
That the Services will be uninterrupted, error-free, or secure.
The accuracy, completeness, or currency of information in the Application.
Fitness of the Application for a particular purpose.
11.2 Limitation of Damages
To the maximum extent permitted by applicable law, Farma360 and its affiliates, directors,
employees, and agents shall not be liable for any direct, indirect, incidental, special,
punitive, or consequential damages arising from:
Use of or inability to use the Application or Services.
Loss, corruption, or unauthorized access to data.
Issues arising from third-party services.
Decisions related to animal health, food safety, or agricultural activities.
Farma360 is not an agricultural consultancy service. Information provided
through the Application is solely for recording and tracking purposes and does not constitute
veterinary, food safety, or agricultural advisory services.
12. Indemnification
You agree to indemnify and hold harmless Farma360, its affiliates, directors, and employees
from and against any and all damages, losses, costs, and expenses (including attorney's fees)
arising from your violation of these Terms, your unlawful use of the Application, or your
infringement of third-party rights.
13. Account Suspension and Termination
13.1 By Farma360
Farma360 may suspend or terminate your account without prior notice in the following cases:
Violation of these Terms.
Unlawful use.
Conduct that endangers the safety of other users.
Use of false or misleading information.
Extended inactivity (more than 12 months).
13.2 By User
If you wish to delete your account, you may submit a written request to
info@farma360tech.com. Your account deletion
request will be processed within 30 days, subject to statutory retention periods.
13.3 Effects of Termination
Upon account termination, your access to the Application and Services ends.
Your user content will be deleted after statutory retention periods expire.
Provisions of these Terms that by their nature should survive termination (intellectual property, limitation of liability, indemnification, governing law) shall remain in effect.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic
of Turkey. Conflict of law rules shall not apply.
15. Dispute Resolution
For disputes arising from these Terms or the use of the Services:
Amicable Resolution: The parties shall first attempt to resolve the dispute in good faith through amicable means.
Mediation: If amicable resolution fails, mediation proceedings are mandatory before filing a lawsuit (pursuant to the Turkish Mediation in Civil Disputes Act No. 6325).
Competent Courts: If mediation is unsuccessful, the Courts and Enforcement Offices of Istanbul shall have exclusive jurisdiction.
Users who qualify as consumers retain their rights under the Turkish Consumer Protection Law
No. 6502 and may apply to the Consumer Arbitration Committees and Consumer Courts in their
locality.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable by a competent court,
such provision shall be enforced to the maximum extent possible, and the remaining provisions
shall continue in full force and effect.
17. Changes
Farma360 reserves the right to modify these Terms at any time. When significant changes are
made, you will be notified through in-app notifications or our website. Your continued use
of the Application after such changes constitutes acceptance of the updated Terms.
These Terms, together with our Privacy Policy, constitute
the entire agreement between the parties regarding the use of Farma360 Services and supersede
all prior written or oral agreements on this subject.
